Coalition Stands Firm Against Court's Refinery Exemption Verdict
USAgNet - 11/29/2023

The Renewable Fuels Association, Growth Energy, American Coalition for Ethanol, and National Farmers Union, representing a coalition of farmers and ethanol producers, recently voiced their concerns following a decision by the Fifth Circuit Court of Appeals. This decision involved remanding the U.S. Environmental Protection Agency's (EPA) rejection of six small refinery exemption requests.

The coalition, while expressing their disappointment, remains unwavering in their defense of the Renewable Fuel Standard (RFS). They assert that the RFS does not place an undue economic burden on oil refiners, as the associated compliance costs are passed through the supply chain.

This latest development is a part of the ongoing struggle between the biofuel sector and oil refineries regarding renewable fuel blending obligations. The coalition believes the lawsuit to be less about the claimed economic hardships and more about some oil refineries trying to shirk their legal responsibilities of blending renewable fuels.

The group's response signals their determination to ensure all refineries, big or small, adhere to the RFS obligations fairly. They emphasize the role of renewable fuels in providing consumers with more affordable and environmentally friendly fuel options.

This incident sheds light on the broader challenges in the energy sector, particularly the integration of sustainable energy sources. The coalition's firm stance in the face of this legal setback is indicative of the ongoing efforts to balance the interests of various stakeholders while progressing towards a more sustainable energy future.
